1. Acceptance of Terms

By accessing or using the NeverGetHired platform (“NeverGetHired”, “we”, “us”, “our”, or “Service”), located at nevergethired.com, including any associated web portals, mobile interfaces, software utilities, smart resume builder, and autonomous job application services, you agree to be bound by these Terms of Service (“Terms”) and our incorporated policies.

If you do not agree to all of these Terms, you must not access or use the Service. These Terms apply to all visitors, registered candidates, recruiters, and employer hiring partners.

2. Description of Services

NeverGetHired is an advanced career acceleration platform that provides:

• Global Job Discovery: Curated and real-time indexed postings across 190+ countries and public ATS platforms (Greenhouse, Lever, Workday, iCIMS, Ashby, and official government gazettes).
• Smart Resume Builder & Tailoring: Grounded resume optimization and tailored cover letters built exclusively from verified candidate-provided data, with no invented qualifications or fabricated experience.
• Guided Application Dispatch: Assisted submission of job applications on behalf of the candidate using only credentials the candidate has reviewed and approved.
• Employer Talent Marketplace: Employer subscription services allowing verified hiring teams to post roles and review prospective candidates.

3. User Eligibility & Accounts

To use our Service, you must be at least 18 years of age or the age of majority in your jurisdiction. You agree to provide accurate, current, and complete information during registration and keep your account credentials secure. You are solely responsible for all activities that occur under your account.

You agree to provide factual, authentic employment records and educational qualifications. Falsifying credentials or misrepresenting identity is strictly prohibited and constitutes grounds for immediate account termination.

4. Subscription Plans, Billing & Payment Processing

NeverGetHired provides both free services and paid subscription tiers. Pricing is transparently presented in United States Dollars (USD):

Payment Processing via Stripe: All payments are securely processed through Stripe, Inc., a certified PCI-DSS Level 1 payment gateway. NeverGetHired does not store, transmit, or have access to full credit card numbers or security codes. By providing payment details, you authorize Stripe to charge your designated payment method for all applicable fees.

Automatic Renewal: Paid subscriptions automatically renew on a monthly billing cycle unless cancelled prior to the renewal date. You authorize us to charge your default payment method on each renewal date.

5. 1-Click Cancellation & 14-Day Refund Policy

Cancellation Anytime: You may cancel your subscription at any time with a single click directly from your Billing Dashboard or Account Settings. There are no cancellation fees, penalty charges, or mandatory long-term contracts. Upon cancellation, your paid subscription will remain active until the conclusion of your current prepaid billing cycle, after which your account will revert cleanly to the Free Starter tier.

14-Day Refund Policy: We offer a 14-day refund policy for first-time subscribers within 14 days of purchase. If you are not completely satisfied, contact us at billing@nevergethired.com within 14 days of initial enrollment for a prompt refund. Approved refunds are credited directly back to the original payment method via Stripe within 5 to 10 business days.

6. Candidate Authorization for Automated Applications

By utilizing our automated application services (Pro or Max tier), you grant NeverGetHired permission to submit applications, transmit your resume, and communicate responses to employers on your behalf using data you have provided and reviewed. You retain full ownership and discretion over where applications are dispatched and may pause, throttle, or cancel active auto-apply jobs at any time.

7. Disclaimers & Employment Outcomes

NeverGetHired optimizes job discovery, tailoring accuracy, and submission volume. However, NeverGetHired does not guarantee specific employment offers, interview calls, or hiring timelines. Hiring decisions remain under the exclusive purview of independent employers and recruiters.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall NEVERGETHIRED SERVICES, its contributors, operators, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability under these Terms shall not exceed the amount actually paid by you to NeverGetHired in the twelve (12) months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales and applicable digital online services regulations, without regard to conflict of law principles.

NeverGetHired is engineered for generational continuity, deterministic reliability, and long-term public availability:

• Perpetual Free Candidate Access: Public job discovery, career searching across 190+ jurisdictions, and candidate account registration remain 100% free forever ($0 fee barrier). NeverGetHired never charges candidates toll fees or application filing tolls to access verified job opportunities.
• 24/7 Autonomous Watchdog & Self-Repairing Architecture: The platform operates with automated self-healing watchdog engines that continuously monitor services, auto-recover transient process drops, clear zombie locks, and guarantee 99.99%+ operational availability.
• Deterministic Backward-Compatible Schemas: All candidate resumes, application histories, and profile states are preserved using immutable, forward-compatible schema standards. Candidate data exports are guaranteed in universal open standards (JSON, CSV, PDF) pursuant to GDPR Article 20.
• Universal Executive Light Theme & WCAG 2.1 AAA Accessibility: The platform is permanently standardized on high-contrast Executive Light typography and sub-pixel antialiasing with zero font blur, ensuring long-term legibility across future devices and operating systems.

11. Cryptographic Receipt Integrity & Zero Backend Leakage Standard

Candidate privacy, verifiable submission audits, and absolute security boundaries are strictly enforced:

• Tamper-Evident SHA-256 Application Receipts: Every application dispatched through our platform generates a unique, immutable SHA-256 cryptographic ledger receipt available at /applications/[id]/receipt. These digital receipts provide non-repudiable proof of submission, employer confirmation timestamps, and payload integrity.
• Zero Backend Information Leakage Policy: Candidate safety is guaranteed through strict UI boundaries. Internal server paths, database credentials, architecture traces, and operational diagnostic telemetry are never exposed to public candidate or visitor interfaces.
• Global Eligibility & International Labor Compliance: Application routing adheres to statutory right-to-work laws, EOR payroll conventions, and visa clearance frameworks across 186+ international countries.
